The 75th DAE Department Council meeting held on 22.11.2019 and the following subjects were discussed and status also exhibited for your knowledge. These are the relevant and important subjects to the BARC employees.










    Subject  and   Status

1    Risk and hardship  allowance to Fire Service Staff  :  Staff side expressed our strong reservation on the denial OM of this allowance in which it is mentioned that ‘DAE fire staff is not fighting fire’. Further in the 74th DAE DC Secretary DAE assured that he will speak to Secretary Department of Space for reviewing the issue. Unfortunately it was not mentioned in the action taken report. Department assured that it will be taken up with Secretary DOS.



2   Implementation of MF OM NO. 13/02/2017-Estt (Pay-I) dt.27.7.2017:
As the BARC administration has put on hold the implementation of above OM by which allowing increments on completion of six months qualifying service from the date of fixation of pay of promotion    The UNION is happy to inform you that the BARC administration has now agreed to implement the above OM by which the employees who are promoted after the year 2016(July) will be allowed to draw next increment in January 1st of the following year. This is confirmed in the DAE Department council meeting held on 22nd Nov 2019.

3    Change of accommodation on Medical ground
DAE was refusing request for change of accommodation on medical ground to those who have already availed change in same category earlier, even on the recommendation of Doctors. This was represented by BARC union
     Now the DAE has agreed to allow changes to the allottees that are seeking change on medical ground even though they have availed change in the same category.

4    Fixation benefit of one increment to those who promoted on 1/11/2018 from Technician E to Technician F and the scale subsequently merged subject. :   As it was submitted the expenditure details (except 3 units viz. IGCAR, GSO & VECC Kolkata) for a final decision it is required the details of above mentioned Units. It is asked the CAOs of the above Unit for early submission.
     
5    Restriction of  facilities to Union/ Association  office :   It is agreed to issue a revised order so that all the facilities can allowed by the concern units.

6    Regarding status of 3rd cadre review. :   With respect to the 3rd cadre review clarification sought by the ministry of finance is submitted by DAE. Continues follow up is being carried out and delegation of DAE officials visited MF on 17/10/2019.

7    Cadre review for canteen employees:    Department informed that the work is assigned to BARC Administration and the proposal is under preparation. As it is demanded by our union one member from the Union will be included in the committee.

8    Patient care allowance to Group A & B employees as per the recommendations of 7th CPC  :  The matter under examination of the DAE.

9    Patient care allowance for the employees who are Group C and because of nomenclature change they have not paid the PCA.  :   The Staff side brought to the notice that the DAE has issued OM stating denial of PCA to the Technician who track changed from Work Assistant. Dental Technician & Dental Hygienists also denied the above allowance. Finally DAE agreed to refer once again to MF(AEC) for approval.

10    Fixation benefits to Senior Account Clerks/Accounts Assistant/Steno Grade II  :   In the recent past the DAE issued OM stating that MF is not approved the fixation benefit/MACP. The union conveyed our strong displeasure and hence it is decided to resubmit the subject  once again to MF(AEC)

11    Revision of DAE Allotment Rules  : The DCSEM informed that the allotment rule is under revision and the entire stake holder is being consulted. Union conveyed the concern that any major change in allotment rule should be discussed with staff side before finalization. It is agreed to.

12    Request to consider the promotion of Assistants who are appointed on merit basis from 1.7.2007 on par with the Assistant promoted under SCF quota. :   Department informed the matter was referred to DOPT and it is turned down the proposal. Union said it is already approved the Ministry of finance and no need to refer to DOPT. It is the matter of second cadre review and notional fixation is allowed according to the OM. After a detailed discussion Department has gone back from the recovery stand and decided to refer to a CAO committee.

13    Separate Building for shousheelya school is demanded by our Union.  :  Separate building for sousheelya special school is being planned near Brindavan Market, Anushaktinagar.

14    Revision of Night Duty Allowance (NDA) in the revised rate. :  The revision of NDA is under the consideration of Ministry of Finance based on 7th CPC recommendation. However the pre revised rate of NDA is being paid to the eligible employees.

15    Construction of Additional housing units in Anushaktinagar. Our proposal was to demolish one room kitchen Type A-Flat & construct of tower building for accommodating more number of employees. :   DCSEM is planning for construction of 20 floors Building (2 Nos-1A transits) and construction will do after 3 years. Union demanded the construction should be initiated immediately as the employees waiting period is more than 12 years for their first allotment. We also suggested instead of 1A it should be 2B as almost all employees staying in 1A are eligible for 2-B

16    Pay fixation /one increment to track changed employees: Staff side demand under OM dated 7/1/2013 that the track changed people also should be allowed fixation benefit of one increment.    Information is sought from various Units for calculation of financial implication and the DAE is working on it.

17    Recruitment of canteen employees:    Department has agreed for the need based recruitment of canteen staff & it is already sought information from various units what type of canteen/infrastructure is available for canteen services in each unit.

18    Promotional avenues to Scientific Assistant -G :    The Department was repeating the same view that for Scientific assistant the existing norm is not permitting promotion after S/A-G. The Union mentioned that it was assured in the past that after 7th CPC implementation a major review of the promotion norms is proposed. All the grievances will be considered at the time of such revision. But even after passing 3 years no revision exercise is carried out and many seniors are retired even completing 10 years in the present grade. We have requested T/O grade to be allowed to such senior employees. However the BARC union is prepared to make a presentation in front of Norm’s committee.
          
19    Fit for promotion after one year based on the performance of interview :    This was an agenda in the Department Council and the staff side sought time for submission of more information

20    Change of promotion policy of Staff Car Drivers:
The drivers are having a limited opportunity for promotion by which they are only going up to the level 5. This disadvantageous position brought to the notice of the Department and requested to frame a promotion policy which follows Department of space.    The Department informed that the 3rd Cadre review is in final stage in which they have proposed an elevated scale of entry for drivers if that is approved the present state of affairs will be changed.

21    Dress allowance Rs.5000 to be extended to all female staff and Technicians who track changed from Work assistant :   It is decided those who track changed will be issued protective clothes depending upon the area of work. Regarding female employees they are eligible for dress allowance.

22    PTAA Higher rate of membership fees (Rs. 2500 per anum)
Union demanded to bring down the higher membership fees to an affordable rate and also to formulate the professional body with a dedicated administrator from the Department. It will ensure the safety and security of the participants :
  The Department informed that the separate body is already constituted to manage the functioning of PTAA. The DAE will forward the request of staff side to reduce the membership fees also.

23    Promotion avenues for LDC in BARC:
Staff side requested that around 61 LDCs are in position without any opportunities of promotion. They are not eligible to write Departmental examinations. Some people are completed 22 yrs of service.

    Department informed that in the 3rd cadre review there is a proposal that all the LDC to be placed in the UDC post and the report may come in any moment.

24    Rotational Transfer policy of DAE(Other than Scientific and Technical) :
The Department formulated the Rotational transfer policy by which all the cadre officers insisted to move out of the present working station. The above policy has put the employees in hardship and functions are affected in almost all the units. The above policy is not discussed with the staff side before implementation. Employees who offer promotion on seniority cum fitness (20%) also put under the same policy which was otherwise considered in same station posting.    The Department agreed to consider the Unions representation and Union also offered few suggestions in this regard.

25    Revision of lodging charges of Guest house/lodging/hostels :
The department has increased the hostel charges exorbitantly and the same is not affordable to the employees on their private visit with family in outstations.    The Department is agreed to review the present charges in force.

26    Service rendered in casual labor/CL(TS) may be counted for promotion in the case of Work assistants:    The request will be refer to Trombay Council for consideration.

There are invariable inquiries about the status of compensatory-off on account of election duty performed on Holidays, Saturdays & Sundays by our BARC employees. This is to inform you all that the Union has already confirmed with HRD&SR&W that required circular will be issued shortly so that Divisions can allow compensatory off.

2.      All the circulars issued by AICTE/HRD reasoned for denying such qualifications for STPT.

            With reference to above mentioned circular issued from your office we would like to invite your kind attention that BARC being the principle employer we have to ensure that the contract labors are paid the minimum wages and ensure other social security measures such as provident fund, ESI, Bonus, etc. We recall the discussion held with the Director BARC that the responsibility of the principle employer to be ensured so that no bad labor practice is allowed in BARC.
          Now it is understood many contractors are not paying their annual bonus in addition to other violations of such as not paying the minimum wages etc.
          In the light of above we request you, as a principle employer you may ensure that all the contract labors are getting bonus before the festival of Diwali.

Sir,
            With reference to the above subject we may invite your kind attention to the following.

1.      A huge no. of employees including technical staff is on election & counting duty till 25th Oct 2019.
2.      Later 27th Oct to 29 Oct is Diwali festival period.
3.      The new timetable of interview of standing selection committee is scheduled from 28th Oct onwards.
4.      No gazette officers/selection committee members are sent for election duty from BARC.
5.      The employees those who are screened in for promotion required minimum ten days time for preparation of interview in their concerned subject.

In the light of above stated position we have received representations from employees who have likely to relieve from Election Commission of India requested to reschedule the interviews so that they are getting sufficient time for preparation.
 Hence this Union request you to postpone the interviews scheduled in the week starts from 28th Oct 2019.

NEW Regularization of absence on account of heavy rain.

Sir,
We have received representations from employees stating that on 04/08/2019 traffic was affected due to heavy downpour. Since 4th August falls on Sunday Round-the-clock employees staying outside the township could not attend office. The details of weather as well as traffic conditions on that particular day already appeared in various Newspapers and Electronic media.
In the above stated circumstances, this Union would like to request you that the Round-the-clock employees who could not attend the office on 04/08/2019(Sunday) may be allowed a special Casual leave and regularize their absence.
