Respected Sir,

            With reference to the discussion held with you on 17th July we would like to invite your kind attention to the following.
             Though, a lot of revision took place in the last decade regarding procedures, posts and appointments in BARC, both in Administration and Technical sides, we still follow the same policy for the appointment of a person on compassionate ground.  In post 6th Pay commission era, the Group D posts are merged with Group C. Even though the children and spouses of most of BARC employees are well qualified but at present we are only offering work assistant post on compassionate appointment. In case of sudden demise of the guardian of the family, they are in deep distress. The most deserving families are considered for compassionate appointment by the Department to their family members either spouse or children. We feel that the policy of Compassionate appointment also needs a timely revision.
            Hence, we request your good officers that, if the applicants are eligible, they may please be considered for appointment in any post within Group C, i.e. from Level 1 to Level 5 according to their qualification.

        This is for your kind consideration and for further action.

Sir,
With reference to the above subject we may allow to invite your kind attention to the following. We write this letter in continuation to our earlier letter dated 1st September 2010 addressed to the controller, BARC in which we have stated as follows.

As per guideline containing in the DOPT OM dated 16/3/1999 where in it has been directed that SC/ST candidate should be appointed provisionally on the basis of whatever prima-facie evidence they are able to produce in support of their claim belonging to SC/ST and such claim to be verified that is through the District Magistrate etc.
 After obtaining the ST certificate the same may be subjected for verification by sending to the concern District authority viz. District collector, Deputy Commissioner, District  Magistrate for confirmation.
Para No 40 of DOPT OM No.36011/6/2010/Estt.(RES) Dt.25/6/2010 where in it has been directed verification of cast certificate of SC/ST/OBC employees is required to be considered by issuing authorities as indicated there in.
Further the subject was discussed with the then Director BARC on 2nd May 2011  and he has opined   that “ Verification of Cast Certificate and validity by the scrutiny committee are two different issues and that the verification is mandatory and validation is required in case of any dispute. However if necessary a reference may be made to DOPT through DAE”.
Seven  years  later it   has been  sent a reference  to CAO(P) BARC  to CAO(A), BARC  on 17th August 2018  seeking the clarification whether any reference is sent to DAE regarding the exact procedure to be followed for verification of cast certificate in respect of SC/ST/OBC belonging to Maharashtra state and appointed in Govt. Service in BARC. If so the decision conveyed by DAE in this regard may be intimated to the undersigned (CAO (P)) immediately.
After passing 11 months no replay is received from  CAO(A) about the status of reference to DAE .In spite of  all the  Establishments in BARC has directed to  issue letters to submit validity  of cast certificate stating “clause 4(2) of Maharashtra Sheduled Cast,Sheduled Tribe,De-notified Tribes(Vimukta Jatis), Nomadic Tribe, Other Backward Classes and Special Backward Catogaries (Regulation of issuance &verification) the Cast certificate 2000 dated 23rd May 2001, the cast certificate issued by the competent authorities shall be valid only subject to the verification and grand of validity certificate by the scrutiny committee.”

It is brought to your notice that the Cast Scrutiny committee has given clarification that “The employees on establishment of Central Governmental Department, it is not necessary to verification of Cast certificate from the Scrutiny committee. The Order is only for the   employees posted in the state of Maharashtra and Semi Government.( O/W No.D.C.S.C.No2/Dhule/service cast/747/2014-15 dated 9/4/2014)

Now all the establishments are started issuing letter to the individual employees asking them to submit the cast validity certificate within stipulated time. It is also warned non- submission of validity certificate within the time limit, action will be initiated against such employees.
In this regard this Union emphasis that BARC employees are governed by the orders issued by the DOPT and endorsed by DAE. There no Orders issued by either DOPT or DAE to sending cast certificate to the scrutiny committee constituted by the Maharashtra State Government. The senior employees are only submitted the cast certificate issued by the District Magistrate/Commissioners/Collectors and they are under severe stress because of this administrative action. It will not be out of place to mention all these employees are completed the process of verification by the issuing authority.

It is therefore request you to instruct the administration to restrain from such action and only comply the DOPT/DAE orders on the subject.

Safety issues related to the Transport Maintenance Unit.

Sir,
We would like to bring your kind attention to the following subject related to Transport Maintenance Unit.
1.      Water entering in change room due to leakage in wall.
2.      Electrical installation is dangerously exposed on the wall.
3.      Exhaust fan is damaged beyond repair due to seepage.
4.      Water tank installed at HVG workshop is not cleaned since many years.
5.      Shortage of Geyser in HVG bathrooms.
6.      Fans not working in HVG workshop.
7.      Water leakage from roof side in LVG workshop.
8.      No Geyser available in LVG bathrooms.
9.      Request to renovate bathrooms and replacement of water taps.
10.  Request to issue Rubber shoes for service section employees of TMS. 
11.  Falling of Glass wool particles from the top of the LVG workshop.

It is therefore request you to look into the matter and act accordingly.

Meeting with the Principal School No. 6 on 25th July 2019




Dear colleagues,
We had a meeting with the principal school no.6 on 25th July 2019 to discuss the grievances submitted by the union on behalf of parents. The letter given has already put in the blog. The following members were present.
A)    A Sreedharan (Gen. Secretary Union) B) Arun Koli (Vice President Union) C) Jitendra Kumar (SAC Member)
1.      Corporal Punishment applied on the students: The Union brought to the notice of the Principal that the incident has already reported and the required remedial action to be adopted. He said it is already noted seriously and already action is initiated. He assured there will be strict instruction to all the teachers that there should not be any corporal punishment on children.
2.      Regarding the supply of refreshment packets provided on the science exhibition day, the principal explained strict action is already began and such incident will not be allowed to happen in future.
3.      He assured the list of School Advisory Committee & Safety committee members with contact number will be displayed. It is also assured the minutes of such meetings also will be displayed in school notice board.
4.      All coolers and filters are made operational and the washrooms are kept clean. The members along with the vice-principle visited the above areas and got satisfied. We have further pointed out that the surroundings of the School area grass cutting and cutting of wild vegetation to be carried out in a priority to avoid snake bite. The principal agreed that the letters will be written to the concern authorities to execute the job. The union also offered all sort of help to the principal in this regard.
5.      On the issue of shortage of teachers principal explained the status. According to him he has received one teacher two days back and expecting Head Mistress to join any time. Union made it clear that the school should be ready with all means for beginning academic year on 1st April itself. These include furniture, other infrastructure and teachers. He agreed to and conveys the view of parents to the higher authorities.
6.      Regarding school calender it is ready and it will be issued within one week. The I.D.Card will be issued within ten days time. The parents invited the attention of the principal that in the absence of proper timetable children forced carry all books. The principal informed that proper instructions are given in the calendar how to reduce the weight of the school bag. He also assured that the teachers will be instructed to plan their classes and convey the children in advance.
The meeting is concluded by offering support from the parent’s community to the school management and requested clear all the clouds between parents and teachers. The principal also appreciated for the best feedback and expected more interaction in the coming days.

Sir,
This Union has received representation from parents of school No.6 and it required an urgent attention from your end. We list out few of the grievances brought by the parents for your reference.                          

1.      On 09.07.2019 two students of 1st standard, section-N, were physically punished by the mathematics teacher. One of the students was slapped so badly that slapping marks were clearly visible on his cheeks even after the school hours. Parents of the affected children have already brought this matter of humiliation and great concern in the notice of the Principal. Please take action to ensure that these kinds of severe punishments, which can harm the children permanently. Also note that the children who witnessed these incidents have become so scared of attending classes now.

2.      On 06.07.19, it was noticed that some packets of refreshments provided to kids during the science exhibition were found to be passed the expiry date. This is a case of utter negligence and carelessness of the management towards children’s health. It came as a shocking as similar incident was already reported from parents of AECS-3 a few days ago.

3.      Details of Safety & School Advisory committees like list of members and their contact details should be displayed in the notice board of school permanently. Minutes of meeting of the aforementioned committees should be displayed in the notice board.

4.      It was observed that many water filters / coolers provided in the school are defunct and children have to go to other floors to drink water. The washrooms are not kept clean as it is required.


5.      Please take action to solve shortage of teachers in the school. It has been observed that shortage of teachers has left many classes unattended / combined which affects the learning process  badly

6.      School calendar, time table and I.D cards are not yet distributed to students even after the academic session has progressed to fourth month.


7.      Please ensure that weight of the school bag be within the stipulated limit set by the CBSE. This can be ensured by employing a proper time table.

It is therefore request you to arrange a meeting with this union along with parent representatives.
